3.3.3.20 Payability of Austudy

Summary

Even though a claimant is qualified, Austudy is NOT payable in the circumstances listed in the following table. If more detail about the circumstance is required, the second column indicates where you will find this.

The claimant does not pass the asset test.

Before the start day of the allowance.

8.3 Start Days

When the claimant is serving:

- an activity test non-payment period, or

- a LAWP, or,

- a NARWP (1.1.N.70), (unless the claimant has a QRE (1.1.Q.35)), or

- an IMP (1.1.I.60), or

- a SWPP (1.1.S.455).

Under the following general payability provisions:

- rate would be nil,

- claimant is in prison,

- compensation preclusion, and

- multiple entitlement exclusion.

Overseas travel

Students may continue to receive their Austudy payment if they travel overseas:

  • during holiday periods for up to 6 weeks, or
  • for the duration of the overseas study while undertaking part of their Australian (1.1.A.320) course at an overseas institution.

 

Australian Apprentices may continue to receive their Austudy payment if they travel overseas as long as their Commonwealth registration number in respect to their full-time Australian Apprenticeship remains current.
