4.4.5.40 Failure to Nominate Bank Account Details

Request for bank account details

Unless an exemption is granted, an instalment claim for FTB is not effective unless the recipient:

  • provides bank account details, or
  • makes a statement that they will provide bank account details within 28 days from the day the claim is lodged.

 

This requirement applies to both an individual (1.1.I.90) and an ACO (1.1.A.80).

 

If the applicant meets the requirement by making a statement that they will provide bank account details within 28 days of making the claim but fail to do so, then the claim is taken not to have been made.

Instalment recipient fails to provide bank account details

The Secretary may require a person who is entitled to be paid FTB by instalment to provide bank account details under section 26A of the A New Tax System Family Assistance (Administration) Act 1999. This might occur where a bank account is closed by the recipient and new account details have not been provided to the FAO. In this situation, there may be a variation to the recipient's FTB entitlement under section 27A if the recipient fails to provide the bank account details within 28 days. The date of effect of the cancellation is the day after the end of the recipient's latest entitlement period.

Instalment recipient subsequently nominates bank account

Where the instalment recipient subsequently nominates a bank account into which instalments of FTB can be paid, the cancellation must be varied. The date of effect of this variation is the date of cancellation. The variation reinstates the determination that applied before the cancellation.
