1.1.P.30 Partner, partner in gaol

Summary

The term 'partner' has the same meaning for FA as under the Social Security Act 1991.

 

Definition: partner

A partner in relation to a person who is a member of a couple (1.1.M.50), is the person's current partner, whether legally married or otherwise. This excludes former partners, whether legally married or otherwise, from whom recipients have separated.

Definition: partner in gaol

A person is in gaol if the person is:

  • imprisoned in connection with the person's conviction for an offence, or
  • being lawfully detained in a place other than a prison, in connection with the person's conviction for an offence, or
  • undergoing a period of custody pending trial or sentencing for an offence.
